What are the Powers of a Certificated Bailiff acting under a Warrant of Distress for Commercial Rent?

A Bailiff has the legal right to seize all and any goods found on the demised premises and arrange for them to be sold at public auction to cover the rent arrears owed to the landlord. The costs of the seizure will be taken from from the proceeds of the sale, these will include the bailiffs costs, the removal costs and auctioneers fees.

Prior to removing a debtors goods, the bailiffs will leave a "Notifice of Seizure" and will give the tennant an opportunity to sign a "Walking Possession Agreement" This is basically a Request by the tennant, for the Bailiff Not to Remove Goods at that time. The signing this agreement allows the tennant to keep the goods which have been seized, on his or her premises, ( the goods remain in the custody of the law and my not be disposed of by the tennant or any other person) this allows a short period of time for the debtor to either pay in full or make payments to the bailiff during the period of the walking posession agreement.
