| The Bailiff A Bailiff may Distrain only if he holds a Certificate in accordance with the Distress for Rent Rules 1988. A Certificate is issued by a County Court Judge. When Distress May Be Made A Distress for Rent may only be made between sunrise and sunset. A Distress for Rent before sunrise or after sunset is illegal, even though there may be daylight. Even though distraining after sunset is an irregularity it may be waived if the tenant agrees. Distress for Rent cannot be made on a Sunday. Where Distress May Be Made Distress may be made upon all goods found upon any part of the premises out of which the rent issues. This does not preclude Distress on goods the public highway which by presumption of law is included in the premises. With the agreement of the tenant,goods not on the premises for which the rent is in arrears may be distrained. We trust that this brief outline may provide a better basic understanding of Distress.
